Mental Health Conditions in the Workplace

Many mental health conditions are protected under the American’s with Disabilities Act (ADA). Employers cannot discriminate against or harass employees or applicants with these disabilities. Reasonable accommodations for these disabilities may be required by law.

In response to the growing number of discrimination charges from those with mental health conditions, the Equal Employment Opportunity Commission (EEOC) has recently published a document Depression, PTSD, & Other Mental Health Conditions in the Workplace: Your Legal Rights, identifying the protections afforded those with specific mental health conditions.
